HELLOQWEEN is a personal hygiene care product. It cannot be exchanged, replaced or refunded once payment has been made (HELLOQWEEN holds a no refund policy except on a case-to-case basis which requires a written request from you, and is subject to review and consent from HELLOQWEEN.) Once sold, it cannot be returned.

Most women can successfully use the menstrual device on their first try. However, some may require several days or even several menstrual cycles before being able to use it correctly and comfortably. You will be able to get support from a link to our online user manual (found on the packaging), FAQ website, our customer care support team as well as our closed community (whatsapp) or authentic sharing.

We have made every effort to provide information and support to new users. We are not liable for any problems or difficulties arising from your use of the cup.

3.4 PROMOTIONAL CAMPAIGNS AND DISCOUNTS

You acknowledge that it is NOT possible to use several promotions at once or in conjunction with each other unless otherwise specified in the particular promotion. The promotional code that was applied before checkout will be the one applied to the order.

You agree that it is your responsibility to confirm which offer you are entitled to and to review your order prior to checkout.

We will not be held liable for extra costs incurred due to any negligence on your part in reviewing a promotional code.

3.5 LIABILITY

To the fullest extent permitted by applicable law, HELLOQWEEN and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from our website.
• Any bugs, viruses, Trojan horses, or similar that may be transmitted to or through our website by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via our website.

3.5.1 Proper Use

You agree that you have read and equipped yourself with the necessary knowledge beforehand on how to properly use and care for the Disc and Cup, including:

1. To properly sterilize the Helloqween Menstrual Disc/Cup in boiling water for at least 3 minutes once a month (before menstruation and/or after menstruation).
2. To learn the best positions and methods of insertion and removal, including to relax the pelvic muscles, wash the hands, ensure proper lubrication and proper folding (for insertion) and seal-breaking (for removal) techniques.
3. To remove and empty the Disc/Cup every 4-10 hours and reinsert if need be.

We shall not be liable for any injuries or damages you incur from the incorrect/improper use or cleaning/maintenance of the Menstrual Disc/Cup

3.5.2 Use In Conjunction With Underlying Female Reproductive Conditions

We recommend that women who have underlying female reproductive conditions including, but not limited to, the following, to consult a doctor or healthcare provider before use of the Menstrual Disc/Cup:

1. Vaginismus
2. Uterine fibroids
3. Endometriosis
4. Variations in uterine position

Though there is no literature to support that the use of the Helloqween Menstrual Disc/Cup in combination with these conditions causes harm, there may be some discomfort on a case to case basis. Your doctor or provider will be able to discuss the individual benefits and risks of the use of menstrual cups with your condition.

You agree that you are responsible for confirming whether you are fit to use the Helloqween Menstrual Disc/Cup before using the Product.

We shall not be liable for any injuries or damages incurred from any negligence on your part to consult a provider beforehand.

3.5.3 Potential Risks

Menstrual cups are generally regarded as safe by the medical community. However, as with all menstrual hygiene products, there is a measure of potential risk, though they are minimal:

• INFECTION – This is a rare complication when hygiene measures are observed. However, it is more likely to be from bacteria on your hands transferred to the cup than from the cup itself. Infections include, but are not limited to, yeast infections and bacterial vaginosis. This can be prevented by washing your hands thoroughly with water and soap before using the Menstrual Disc/Cup. You should only wash your disc/cup with a mild, fragrance-free, water-based soap before and after use. We cannot be held responsible and do not offer any kind of compensation in any cases of infection.

• PAIN AND INJURIES – Inserting any object into the vagina may cause pain or small injuries. You are more likely to experience these issues if you insert the Menstrual Disc/Cup in a rough manner, have long nails, or are using an incorrect size. This could be due to differences in anatomy or that the Menstrual Disc/Cup is in an incorrect position. We cannot be held responsible and do not offer any kind of compensation in any such cases.

• INTRAUTERINE DEVICE (IUD) – The Helloqween Menstrual Disc/Cup can be used with IUDs, but we strongly recommend consulting your doctor and/or gynecologist prior to use. As long as the Menstrual Disc/Cup is inserted and removed properly (by breaking the seal before pulling it out), it is safe to use in conjunction with the IUD. We cannot be held responsible for any kind of IUD errors or failings, or the consequences of such a failing, including it being dislodged, and we do not offer any kind of compensation in such cases.

• TOXIC SHOCK SYNDROME (TSS) – TSS is a rare, but severe condition that has been linked to, but not limited to, usage of tampons in women. It is a complex infection and is infrequently seen with the use of menstrual cups. However, in order to minimize this risk, we recommend the following:

• Sterilize your Menstrual Disc/Cup before using it at the beginning of every period (see Proper Use).

• Remove the Menstrual Disc/Cup every 4-10 hours during your period, empty and wash thoroughly before reinserting.

• Do not use the Menstrual Disc/Cup or any internal vaginal devices if you have previously been diagnosed with TSS.

• Wash your hands every time you handle the Menstrual Disc/Cup

• We cannot be held liable for any cases of TSS linked to the use of the Helloqween Menstrual Disc/Cup.

• ALLERGIC REACTIONS – You agree that you are responsible to check if you have an existing allergy or sensitivity to silicone before using the disc/cup. There is minimal risk of developing allergies, sensitivities or irritations due to usage. However, if you do develop an allergic reaction, we cannot be held responsible and do not offer any kind of compensation in such cases.

3.5.4 Medical Attention

Although potential risks are highly unlikely, it is possible. See and talk to a doctor or other healthcare provider if you begin experiencing:

1. Unusual vaginal discharge
2. Vaginal pain or soreness
3. Burning during urination or intercourse
4. Foul odor from the vagina
5. Inability to remove after 10 hours

You should seek immediate medical attention if you experience:

1. A high fever
2. Dizziness
3. Vomiting
4. Rash (may resemble sunburn)

3.5.5 Force Majeure

We cannot be held responsible for an unseen event of force majeure and as such are not contractually bound to fulfill any obligations.

4. SUPPORT FROM HELLOQWEEN

The information provided on our website is intended to ONLY be product-related guidance. Our support staff can ask for information from you to guide you with regards to product-use ONLY. Any advice that can be construed as medical coming from our staff, unless stated explicitly is from a Doctor, will not be treated as such.

If you have medical-related questions or concerns, we strongly recommend that you consult a doctor or gynecologist for more information. Any guidance by our support staff cannot be construed as medical advice.

We cannot be held responsible for any advice given by third parties on forums or social media, including our Whatsapp and Telegram Community Group (Helloqween Community) about the menstrual disc/cup. You agree to verify this information yourself. We will not give compensation for any cases related to this.

5. INDEMNIFICATION

You agree to indemnify, defend and hold harmless HELLOQWEEN and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third-party.

6. SEVERABILITY

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
